Subclass 820/801 – Partner Visa (Temporary/Permanent):

This visa caters for individuals who are in a de-facto or spousal relationship with an Australian citizen, permanent resident or an eligible New Zealand citizen. If an individual is in a de-facto relationship, the duration of the relationship must be at least 12 months. The temporary visa is a combined application with the permanent visa application.

With this Visa:

  • You must be in a genuine relationship with your spouse or de-facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen.
  • You must have comprehensive and sufficient evidence of your relationship to support your claims of being in a relationship with your partner.
  • You must meet the de-facto or marriage requirements.
  • If you are in a de-facto relationship, you must meet the 12-month relationship requirement, unless you are eligible for a waiver.
  • You must not have had a visa refusal or cancellation.
  • You must be in Australia at the time of application and decision.
  • Your sponsor must be an eligible sponsor and is not barred from sponsoring you.
  • You must satisfy the Australian health and character requirements.
  • You will be able to stay in Australia while the Department processes your application.
  • You will be able to work and study in Australia.
  • You will be able to attend the free English language classes provided by the Adult Migrant English Program.
  • You will be able to enrol in Australia’s public health care scheme such as obtain Medicare.

Subclass 461 – New Zealand Citizen family Relationship (Temporary):

This visa caters to individuals who are family members of a New Zealand citizen who lives in Australia. You can be either inside or outside of Australia.

With this Visa:

  • You must not be in Australia when you make your application.
  • Your application must be made online.
  • If you are in Australia, you must be a holder of a substantive visa upon lodgement of your application.

Subclass 836/116 – Carer Visa Onshore/Offshore (Permanent):

This visa caters to individuals who will be providing care for someone who has a long term medical condition. The person who is receiving the care must not be able to undertake and perform daily tasks for themselves and do not have any reasonable access to care options in Australia. This visa requires the sponsor to be a relative of the applicant or the partner of the sponsor who is an Australian Citizen, permanent resident or eligible New Zealand citizen.

With this Visa:

  • You must be willing to be able to provide ongoing substantial care and support for your sponsoring relative or the family member who resides with them.
  • Your sponsor must be your relative or your relative’s partner.

Subclass 835/115 – Remaining Relative Visa (Temporary/Permanent):

Subclass 173 – Contributory Parent Visa (Temporary):

This visa caters to individuals who is a parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen. This visa allows for a stay of approximately 2 years. This is a pathway to permanent residency by way of subclass 143 visa.

With this Visa:

  • You must meet the balance of family test.
  • You must not have made an application for subclass 870 temporary visa.

The main requirement of this visa is to satisfy the balance of the family test and the processing time for this visa could be up to 4.5 years.

With this Visa:

  • You must have assurance of support.
  • You do not have to under a certain age.
  • You will be able to live, work and study in Australia permanently.

This visa allows for a stay of approximately 2 years. This is a pathway to permanent residency by way of a subclass 864 visas.

With this Visa:

  • You must meet the age requirement.
  • You must meet the balance of family test.
  • Your sponsor must be approved to be your sponsor.
  • You must meet the Australian health and character requirements.
  • You will be able to live, work and study in Australia for up to 2 years.
  • You may travel to and from Australia as many times as you require.
  • You may be eligible to apply for the subclass 864 permanent visa.
  • You may make your application for this visa while you are inside of Australia.

To satisfy the balance of the family test, parents must have at least half of all their children lawfully and permanently residing in Australia. The age requirement will be gradually increased from 65 to 67 depending on the year the applicant was born. Subclass 864 – Contributory Aged Parent Visa (Permanent):

This visa caters to aged parents of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen who resides in Australia. The parent must be aged in accordance with the retirement age under the Australian Social Security Act.

With this Visa:

  • You must meet the age requirement.
  • You must meet the balance of family test.
  • Your sponsor must be approved to be your sponsor.
  • You must meet the Australian health and character requirements.
  • You must have assurance of support.
  • You must be in Australia at the time of application.

To satisfy the balance of the family test, parents must have at least half of all their children lawfully and permanently residing in Australia. The age requirement will be gradually increased from 65 to 67 depending on the year the applicant was born. Subclass 870 – Sponsored Parent Visa (Temporary):

This visa caters to individuals who are biological, step or adoptive parents of an Australian citizen, Australian permanent resident or eligible New Zealand citizen. This visa responds to community concerns about the limited number of parent visa places available in the migration program and lengthy waiting period. This visa does not have the balance of family test or assurance of support requirement. The period of stay for this visa can be for a duration of 3 or 5 years.

With this Visa:

  • You must be the biological, step or adoptive parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
  • Your sponsor must be at least 18 years of age.
  • Your sponsor’s household income must be deriving at least $83,450 annually.
  • Your sponsor must have complied with all previous visa obligations.
  • You must have access to sufficient funds to support your stay in Australia.
  • You must meet the Australian health and character requirements.
  • You must have the genuine intention to stay in Australia on a temporary basis.
  • You must have health insurance during the life of your visa.
  • You must make your application outside of Australia.

Subclass 103 – Aged Parent Visa Offshore (Permanent):

This visa caters to parents of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen. This visa has a processing time of approximately 30 years. The assurance of support required is significantly less than of other parent visas. This visa could be lodged whilst the parent is inside or outside of Australia, however, at the time of grant, the parent must be outside of Australia. Each year only 1,500 places have been allocated to the subclasses 103 and 804 visas.

With this Visa:

  • You must be an aged parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
  • You must meet the balance of family test.
  • Your sponsor must be approved to be your sponsor settled in Australia.
  • You must be sponsored by your child who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
  • You must meet the Australian health and character requirements.
  • You must not have had a subclass 870 temporary visa when applying for this visa.

With this Visa:

  • You must be an aged parent of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Subclass 101/802 – Child Visa – Onshore/Offshore (Permanent)

This visa caters to individuals who are children of a parent who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen. The key requirement of this visa is dependency. This visa permits the child to stay in Australia indefinitely and live with their parent permanently. Each sibling must make separate applications. The child must be a biological, step or adopted child of the sponsoring parent.

With this Visa:

  • You must be dependent on your parent who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
  • You must be under the age of 18 years old. If you are over the age of 18 years old and under 25 years old, you must fall into the category of studying full time or have a disability.
  • You must be studying full time since turning 18.
  • You must be under the age of 25 years old at the time of decision.
  • You must be single.
  • You must never have had a partner.
  • You must not be working full time.
  • You must meet the Australian health and character requirements.
  • You will be able to stay in Australia indefinitely.
  • You will have full rights to study in Australia.
  • You may be able to sponsor eligible family members to come to Australia.
  • You may be eligible to apply for Australian Citizenship.

Subclass 445 – Dependent Child visa (Temporary):

This visa Caters for individuals who are a child of a parent who is a holder of a temporary 309 or 820 partner visa. This visa was designed to permit dependent children of those parents who are awaiting the final decision of their permanent partner subclass 801 or 100 visa to remain in or travel to Australia to be with their parent.

With this Visa:

  • You must be financially dependent on your parent who is the holder of a temporary 309 or 820 partner visa.
  • Your sponsor must be the same sponsor who had sponsored your parent who is the holder of a temporary 309 or 820 partner visa.
  • You must be under the age of 18 years old.
  • You must meet the Australian health and character requirements.
  • You will be able to be combined with your parent on their permanent partner application.
  • You will be able to stay in Australia until the Department makes their decision on the permanent partner visa application.
  • You will be able to work or study while you remain in Australia.

Subclass 405 – Investor Retirement Visa (temporary):

This visa caters for individuals who are retired and would like to invest and live in Australia during their retirement years. This visa is specifically targeted to individuals who do not have dependents and are a self-funded retiree. The designated investment must be maintained for the duration of the visa life being 4 years.

With this Visa:

  • You must be at a retirement age.
  • You must be able to invest at least AUD250,000 at the first time of application of this visa and maintain that amount. At the re-application time, you must be able to invest AUD500,000.
  • You and or your partner must have access to at least a minimum of AUD65,000 per year net income.
  • You must be sponsored by an Australian State or Territory.
  • You must meet the Australian health and character requirements, unless you meet the compelling and compassionate exception.
  • You will be able to work up to 40 hours per fortnight.
  • You will be able to travel to and from Australia as many times as you require.
  • Your eligible partner may accompany you to Australia.
